California Privacy Supplement

The California Consumer Privacy Act or “CCPA” (Cal. Civ. Code § 1798.100 et seq.) and the Shine the Light law (Cal. Civ. Code § 1798.83) afford consumers residing in California certain rights with respect to their Personal Information. If you are a California resident, this California Privacy Supplement (“Supplement”) applies to you.
This Supplement supplements the Comfort Systems USA Privacy Policy and applies only to California consumers whose Personal Information is collected by a Comfort Systems operating company identified below as a “Covered California Entity.” It is intended to provide the disclosures required by the California Consumer Privacy Act, as amended (the “CCPA”).
This Supplement does not apply to job applicants or employees. Those individuals may receive a separate notice where required. This Supplement also does not apply to information or entities excluded from the CCPA, including information subject to applicable statutory exemptions.
Covered California Entities
This Supplement applies only to operating companies that are subject to the CCPA (collectively, the “Covered California Entities”). Each Covered California Entity is responsible for the Personal Information it collects and for responding to requests relating to that information. The categories and practices described below may vary by Covered California Entity and by the nature of your interaction.
Notice at Collection
In the preceding 12 months, we have collected the categories of Personal Information set forth in the table below. For details about the precise data points we collect and the categories of sources of such collection, please see the “Information We Collect About You and How We Collect It” section in the Policy. We collect Personal Information for the business and commercial purposes described in the “How We Use Your Information” section in the Policy. In the preceding 12 months, we have disclosed the following categories of Personal Information for business purposes to the following categories of recipients, which we also describe in greater detail in the “Disclosure of Your Information” section in the Policy. A particular Covered California Entity may not collect every example listed.

Sensitive Personal Information
Under the CCPA, certain types of Personal Information are considered “Sensitive” Personal Information and require additional data privacy rights and obligations. The Covered California Entities do not collect, use, or disclose Sensitive Personal Information. As such, we do not provide consumers with a right to limit the use and disclosure of Sensitive Personal Information.
Selling or Sharing of Personal Information
We do not “sell” your Personal Information or “share” your Personal Information for cross-context behavioral advertising, as defined by applicable privacy law, and have not done so in the prior 12 months. We also do not knowingly “sell” or “share” the Personal Information of children under the age of 18, and have not done so in the prior 12 months.
Your Privacy Rights
Subject to applicable exceptions, California residents may have the following rights with respect to Personal Information maintained by a Covered California Entity:
- Right to Know and Access. Request the categories and specific pieces of Personal Information collected about you, the categories of sources, the business or commercial purposes for collection, sale, or sharing, and the categories of third parties to whom information is disclosed, sold, or shared.
- Right to Delete. Request deletion of Personal Information collected from you.
- Right to Correct. Request correction of inaccurate Personal Information maintained about you.
- Right to Data Portability. Receive responsive information in a portable and, to the extent technically feasible, readily usable format.
- Right to Opt Out of Sale or Sharing. Direct a Covered California Entity not to sell or share your Personal Information. This right applies only if the entity engages in sale or sharing as defined by the CCPA.
- Right to Non-Discrimination. Not receive discriminatory treatment for exercising a CCPA right.
How to Exercise Your Rights
To submit a request, call us at (713) 830-9600 or email us at information@comfortsystemsusa.com. Please identify the Covered California Entity with which you interacted and provide enough information for us to understand and respond to your request. We may ask you to provide information reasonably necessary to verify your identity. We will use Personal Information provided for verification only for that purpose and related security or fraud prevention purposes. If we cannot verify your identity to the degree required by law, we may deny the request in whole or in part and explain the basis for the denial.
We will confirm receipt and respond within the time required by law. If we deny a request, we will provide the explanation required by law and disclose any responsive information not subject to an exception. You may make a request to know no more than twice within a 12-month period.
Authorized Agents
You may designate an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may ask you to verify your identity directly with us or confirm that you authorized the request, unless the agent holds a valid power of attorney under applicable law.
Opt-Out Preference Signals
Where a Covered California Entity sells or shares Personal Information, it will process recognized opt-out preference signals in accordance with the CCPA. The signal will apply to the browser or device from which it is sent and, where known, may also apply to the associated consumer profile. You may need to use the signal on each browser or device you use. The applicable website will provide a means to confirm the status of the opt-out request.
California “Shine the Light” Disclosure
The California Civil Code permits California residents with whom we have an established business relationship to request that we provide a list of certain categories of Personal Information that we have disclosed to third parties for their direct marketing purposes during the preceding calendar year. To make such a request, please send an email to information@comfortsystemsusa.com or otherwise contact us using the information set forth below. Please mention that you are making a “California Shine the Light” inquiry. Please note, however, that we do not currently disclose any Personal Information to third parties for their direct marketing purposes.
Changes to this Supplement
We may update this Supplement from time to time. We will post the updated version and revise the “Last Updated and Effective Date” above. If required by law, we will provide additional notice of material changes.
